By accessing or using this website (the “Site”), you agree to be bound by these Terms of Use and Conditions ("Terms" or "Conditions"). If you do not agree, please do not use the Site.

REGARDING ALCOHOL


Alcohol Eligibility & Legal Compliance

You must be 21 years of age or older to purchase or receive alcoholic beverages from Wild Tide. All shipments containing alcohol require the signature of a sober adult aged 21 or older at the time of delivery. Alcoholic beverages purchased through our Site are intended for personal consumption only and may not be resold.

We are unable to ship alcoholic beverages to PO Boxes or APO/FPO addresses due to regulatory restrictions.

Age Representation. By accessing the Site or purchasing alcoholic beverages, you represent and warrant that you are at least 21 years of age and that any person receiving alcohol purchased by you is also at least 21 years of age. Misrepresentation of age, identity, or eligibility is grounds for refusal of service and cancellation of orders. 

Customer Compliance With Applicable Laws. Your are solely responsible for ensuring that your purchase and receipt of alcoholic beverages complies with all applicable federal, state, and local laws. We may cancel or refuse any order that appears to violate applicable law and disclaim liability for shipments delayed, rejected delivery, or confiscated due to regulatory reasons.

 

Orders & Availability

We operate one or more online storefronts offering consumer products, including alcoholic beverages, to eligible customers. Certain products may be available for one-time purchase, while others may be offered through subscription or recurring delivery programs subject to additional terms.

Product availability, selection, and offers may vary by state and are subject to applicable laws and inventory constraints. If a specific product included in an order or subscription shipment is unavailable, we may substitute a comparable product of similar style and equal, or greater, value.

We reserve the right to decline or cancel any order that does not comply with applicable laws or for any other legitimate business reason. In such cases, payment will not be processed or will be refunded if already charged.

Pricing, promotions, and discounts may change at any time. We are not responsible for typographical errors, pricing inaccuracies, or omissions. If an error affects your order, we reserve the right to cancel the order and issue a refund, which will be your sole remedy.

We currently ship alcoholic beverages only within the State of California. Any order placed for delivery outside California is void and may be cancelled with or without notice. If payment was processed, a refund will be issued as the customer's sole remedy.

 

Subscription & Recurring Orders

Certain products may be offered through subscription programs that involve recurring shipments and automatic billing. By enrolling in a subscription, you authorize Wild Tide to charge the payment method on file in accordance with the shipment schedule or renewal period associated with your selected program.

Subscriptions do not require a long-term commitment and may be canceled at any time prior to the next billing cycle by logging into your account or contacting us at info@drinkwildtide.com. Upon cancellation, no further recurring charges will be processed.

If pricing for subscription shipments changes, we will provide advance notice and give you the opportunity to cancel your subscription before the updated price takes effect.

 

Taxes, Limits & State Restrictions

State and local laws governing alcohol sales, shipment limits, and taxes vary. Customers are responsible for understanding and complying with all applicable regulations in their destination state.

We utilize licensed third-party partners to facilitate alcohol sales and delivery. Due to federal and state law restrictions, we are able to ship to California residents only at this time. 

 

Payment Processing & Authorization

Payments are processed through Shopify and its affiliated third-party payment providers. Shopify supplies the e-commerce platform and secure payment infrastructure used for transactions on this Site. Purchases are subject to Shopify’s applicable terms and policies.

By completing a purchase, you authorize us and our payment partners to charge and store your selected payment method, including billing after expiration where permitted, to support order fulfillment and future transactions.

All billing and account information must be accurate, complete, and current. Failure to provide accurate information may result in order delays, cancellation, or inability to process payment.

 

Shipping Changes & Redirection

Once an order has shipped, any requested changes to the delivery address may result in additional shipping charges, taxes, or fees, which are the responsibility of the customer. Shipments containing alcohol cannot be redirected to a different state once in transit.

 

Tracking & Delivery

Tracking information will be provided when available so customers can monitor delivery and ensure an eligible adult is present to sign for the package. We are not liable for missed delivery attempts, return shipping fees, re-delivery fees, holding fees, or any applicable restocking fees due to tracking information delays, changes, or system errors of any type affecting delivery and tracking information to the customer. Alcohol shipments are delivered by a third-party carrier. Delivery timing is controlled by the carrier. Proof of delivery, including a digital adult signature, is required.

Adult Signature Requirements; Failed Delivery Attempts. If a sober adult age 21 or older is not available to sign for the shipment, the carrier may attempt re-delivery. If the shipments returned due to inability to obtain an adult signature, the customer is responsible for return shipping fees, re-delivery fees, holding fees, and any applicable restocking fees. Shipping charges are non-refundable.

All alcohol shipments will bear the required notice: "CONTAINS ALCOHOL: SIGNATURE OF PERSON AGE 21 YEARS OR OLDER REQUIRED FOR DELIVERY."

 

Returns & Refunds for Alcohol Products

Due to federal and state regulations, alcoholic beverages may not be returned once shipped, except where required by law. We may replace or refund products that are damaged, defective, or incorrect upon delivery. Returns for preference or change of mind are not accepted.

 

Accessibility

We are committed to ensuring that individuals with disabilities have access to our products and services. We strive to maintain accessibility consistent with recognized standards such as WCAG guidelines. Our total liability shall not exceed the amount paid for the product giving rise to the claim.

You agree to indemnify and hold harmless Wild Tide Beverages, LLC and its owners, members, employees, and agents from any claims, losses, liabilities, damages, or expenses arising from your use of the Site or products, your violation of these Terms, or any misrepresentation by you.
